Q. Is this legal?
A. Yes!
It is generally understood and agreed that individuals do not
have the right to an expectation of privacy while in the public
domain. This is evident when observing the number of surveillance
cameras in public areas and business’. However, a Video
Shopping end user (client) should take as many steps as possible
to inform their front line employees of their use of this program.
This accomplishes multiple goals. Employees should assume that
every customer they encounter is video shopping their interaction.
This will help to avoid any problems that could arise in a Two
Party state as regards state recording laws. Employee awareness
also improves the performance of the associates involved. The
Shadow Agency - Newmark is
also licensed by the Texas Board of Private Investigators and
Private Security Agency.
Q. Who
owns the videos produced and how is information kept confidential?
A.
The end user (client) is the owner of all
videos produced on their behalf. The
Shadow Agency - Newmark maintains
the original of all shops performed for a period of one year
at which
time the original tape is destroyed or erased. The
Shadow Agency - Newmark will
consider all information regarding end user (client) shops to
be confidential and will protect the tapes and the information
they represent accordingly.
Q. Who does the shops
and how are they trained?
A.
The
Shadow Agency - Newmark hires and trains shoppers
that meet a variety of criteria including but not limited to past
shopping experience, communication skills, neatness of appearance,
availability, geographic location and job history. Shoppers are
trained on a one on one basis and are coached throughout the whole
process from equipment use to actual shopping interaction. New
shoppers do many shops and review their performance until it is
decided by their coach that they are ready for actual field work.
